Terms of Service

1. Acceptance

By creating an account or using HisaabNow, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.

These terms constitute a legal contract between you and Prashant Sharda, sole proprietor, trading as HisaabNow, based at Prateek Wisteria, H-404, Sector 77, Noida, Uttar Pradesh 201301, India.

2. Who can use HisaabNow

• You must be at least 18 years old.
• You must be legally competent to enter a contract under Indian law.
• You must operate or manage a legitimate business. HisaabNow is not designed for personal or household use.
• You must provide a valid Indian mobile number for OTP-based authentication.
• You must use the app lawfully and in compliance with applicable laws, including GST, Income Tax, and local business regulations.

3. Your account

• Your account is tied to the phone number you register with. You are responsible for keeping this number and your device secure.
• You may not share your account with others or allow anyone else to log in as you.
• We may suspend or terminate accounts that violate these terms, are used for fraud, or remain inactive for 365 days or more.
• You can delete your account at any time (see Delete Account).

4. Free tier and paid subscriptions

HisaabNow offers a free tier and paid subscription tiers (Basic, Pro, King). Paid tiers are billed monthly or annually. Features available in each tier are described in the app at the time of purchase.

4.1 Pricing

Current pricing is displayed inside the app. Prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. We may change pricing from time to time; existing subscribers will be notified at least 30 days before price changes take effect.

4.2 Payment

Subscription payments are collected via UPI transfer or other payment methods available in the app. Upon confirmation of payment, your account is upgraded to the selected tier, typically within 24 hours.

4.3 Renewals

Subscriptions do not auto-renew at present. Before the end of your subscription period, you will be prompted to renew manually. If you do not renew, your account automatically reverts to the free tier at the end of the paid period.

4.4 Refunds

Subscription payments are non-refundable once activated. However, if a technical defect in the app (confirmed by our support team) prevents you from using paid features for more than 7 consecutive days, we will issue a pro-rated refund for the unused period.

Refund requests must be sent to privacy@hisaabnow.com within 30 days of the issue. Refunds are processed within 15 business days to the original payment method.

5. Your data and content

You retain full ownership of the business data you enter into HisaabNow — your bills, customers, udhaar, products, and all other records. We do not claim any ownership or usage rights over your business data.

You grant us a limited license to process your data only for the purpose of providing the app's functionality (syncing, displaying, backing up, generating reports). This license ends when you delete your account.

6. Your responsibilities as a data controller

When you enter customer data (names, phone numbers, udhaar amounts), you are acting as a data controller under the Digital Personal Data Protection Act, 2023. You are responsible for:

• Obtaining your customers' consent before storing their personal data.
• Using their data only for legitimate business purposes.
• Responding to your customers' requests to access, correct, or delete their data.
• Complying with all applicable data protection laws.

HisaabNow acts as a data processor and stores your customers' data on your behalf, under your instructions. We do not use your customers' data for any other purpose.

7. Acceptable use

You agree not to:

• Use the app to record transactions for illegal activities or to launder money.
• Enter false data or impersonate another person or business.
• Attempt to gain unauthorised access to other users' accounts, our servers, or our infrastructure.
• Reverse engineer, decompile, or extract source code from the app.
• Use automated scripts, bots, or scrapers against our services.
• Resell access to your account or white-label our app without our written permission.
• Send abusive, threatening, or spam messages through any communication feature.
• Use the app in a way that violates the rights of any third party, including intellectual property rights.

Violation of these rules may result in account suspension or permanent termination without refund.

8. Intellectual property

HisaabNow — including its name, logo, software, design, content, and trademarks — is the property of Prashant Sharda. We grant you a limited, non-exclusive, non-transferable license to use the app for the purposes described in these terms.

You may not:

• Copy, modify, or create derivative works from any part of HisaabNow.
• Use our name, logo, or branding without written permission.
• Frame or mirror any part of the app without written permission.

9. AI-generated content (Munim)

The Munim AI assistant generates suggestions and insights using a large language model. AI responses are not financial, legal, or tax advice. They are educational suggestions to help you think about your business. You remain responsible for all decisions you make.

AI may occasionally produce inaccurate, incomplete, or inappropriate responses. Do not rely on AI output for critical business, tax, or legal decisions without independent verification.

10. Disclaimers

Specifically, we do not guarantee that:

• The app will be available 100% of the time.
• Bugs will be fixed immediately.
• Your data will never be lost (we strongly recommend you do not rely solely on the app for business-critical records; periodically export or back up your data).
• The app will meet every regulatory or compliance requirement for your specific business.

11. Limitation of liability

To the maximum extent permitted by law, HisaabNow and its operator shall not be liable for:

• Indirect, incidental, consequential, or punitive damages of any kind.
• Loss of profits, revenue, goodwill, data, or business opportunities.
• Damages arising from your inability to use the app, even if we have been advised of the possibility of such damages.
• Damages arising from third-party services integrated with the app (Google, OpenAI, payment processors).

Our total aggregate liability in any matter arising from or related to these terms shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or ₹5,000, whichever is lower.

12. Indemnification

You agree to indemnify and hold harmless HisaabNow and its operator from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these terms.
• Your violation of any law or regulation.
• Your violation of third-party rights, including your customers' data protection rights.
• Your business activities conducted using the app.

13. Changes to these terms

We may update these terms from time to time. Material changes will be notified via an in-app banner at least 7 days before they take effect. Your continued use of the app after the effective date constitutes acceptance of the revised terms. If you do not agree, you should delete your account before the effective date.

14. Termination

We may suspend or terminate your account if:

• You violate these terms.
• Your account is used for fraud, abuse, or illegal activity.
• We are required to do so by law.
• We discontinue the service (we will provide at least 60 days' notice in such case).

Upon termination, your right to use the app ends immediately. We will provide a reasonable window to export your data unless termination is due to severe breach of these terms.

15. Governing law and jurisdiction

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Noida, Uttar Pradesh.

Before initiating legal proceedings, both parties agree to first attempt resolution in good faith through email correspondence with our grievance officer for a period of at least 30 days.
